PLEASE NOTE: THE FILING DEADLINE TO SUBMIT A CLAIM TO THIS SETTLEMENT HAS PASSED. MCAG WILL SUBMIT LATE CLAIMS FOR A BRIEF PERIOD FOLLOWING THE DEADLINE FOR NEWLY ENROLLED AND ELIGIBLE CLIENTS, BUT CANNOT GUARANTEE THAT THEY WILL BE ACCEPTED BY THE SETTLEMENT ADMINISTRATOR. MCAG WILL UPDATE CLIENTS ACCORDINGLY ONCE INFORMATION IS AVAILABLE ON DISTRIBUTIONS FROM THIS SETTLEMENT.


Overview

The Settlement arose from lawsuits alleging that Defendants colluded to fix, raise, maintain or stabilize prices on lithium ion batteries, which resulted in overcharges to indirect purchasers of products containing the batteries.


Eligibility

Eligible Class Members include persons and entities that, from January 1, 2000, through May 31, 2011, indirectly purchased Lithium Ion Batteries (“Li-Ion Batteries”) and/or Lithium Ion Battery Products (“Li-Ion Products”) in the United States for their own use and not for resale from one or more of the Defendants in this lawsuit. “Indirectly” means the product was purchased from someone other than the manufacturer, such as a retail store.


Eligible purchases include portable computers (laptops, notebook and tablet computers, cellular phones, and smartphones, etc.), camcorders, power tools, as well as replacement batteries for each of these products.


Excluded from the Class are any federal, state, or local governmental entities, any judicial officers presiding over this action, members of their immediate families and judicial staffs, and any juror assigned to this action, but included are all non-federal and non-state governmental entities in California.
